our settlers in Prowers County, one of them - Chenoweth - an . old

settler and the other one - Dean - a recent purchaser.

Both these

men were so pleased with Prowers County tbat they undertook to work up

other sales in the districts from which they came.

Chenoweth has been

successful and sold a good deal of land to his friends last season. Dean

of course has not yet had a chance to try what he can do.

Both

these men are above the average in intelligence and are fair minded,

hon-est men who started out with a

prepossession

in favor of Prowers County.

You will see for yourself the tone in which they write, and it is evident

to us that things must be radically wrong in the local management out

there before men of this clas~ would write as they do.

It is

per-fectly obvious tmt Chenoweth hits the nail square on the head when he

says that we have been selling land faster than the Company's

representa-tives in Prowers County have been able to prepare it for settlement.

The truth is that while the local management has been attending to a

great many other matters of importance it appears that little or no

attention has been paid to getting the lands ready for the settlers who

had bought, and it is evident that in the matter of getting laterals,

measuring boxes, etc., ready opportunities were neglected last fall which

if properly utilized would have removed most if not all of the complaints

with which we are now being deluged.

The mistake is likely to prove

an expensive one, as it appears to us self evident that in order to stem

the tide of dissatisfaction which has arisen amongst our settlers it

will be necessary for the Company to pretty largely

rebate interest and

water assessments this year to those settlers who have sustained damage

by reason of their requirements not having been properly and

intelligent-ly attended to by the local management.

We enclose copy of letter

which we are writing to Mr. Wiley in t his connection, for your

informa-tion, which explains itself.

local management at Holly we do not wish it to be understood that we

are ma.king any complaint against Mr. Wiley personally.

We are aware

that he devotes his whole time and energies to the interests, as he

understands them, of the Company, and tbat it is impossible for any

man to do more than his best, which we are satisfied Mr. Wiley is doing.

The trouble really lies in the fact that the people at Holly are totally

unfarniliar with the whole business of land colonization and do not

appreciate the relative importance of matters which in themselves appear

trifling.

In illustration of this, v.e have received a letter from Mr.

Wiley in connection with the complaint made by Thos. Gardner to which we

called your attention a short time ago.

In Mr. Wiley's letter he

acknowledges receipt of our letter to him on the subject and explains

that he is attending to Mr. Gardner as fast as possible and would have

attended to it sooner but for the fact that Mr. Paul Morton of the Santa

Fe R'y and some of hie friends had been at Holly.

Now we are aware

that nine out of eve-ry ten men would consider that Mr. Paul Morton was

more important to attend to than Mr. Thos. Gardne½and yet the exact

-2-It is of infinitely more importance to the success of the Amity Co. that Mr. Thos. Gardner and his lateral shouldbe attended to

that Mr. Paul Morton and his friends should be driven over the country, and tbis is where, in our opinion, the local management at Holly make a mistake. It is not necessary that Mr. Wiley should spend his time in personally attending to details as to measuring boxes, etc., of the settlers, but

it is very necessary that he should see that this work is done by proper people and that he should keep sufficiently close track of such matters to be sure that no causes for complaint arise, and when causes of com-P+a,in~ which he himself admits are well founde~ have arisen it should be understood that there is nothing that can possibly arise at Holly of equal importance with the remedyin~ of the complaint. It is totally useless for us to attempt to continue the work of colonization unless these matters can be remedie~ and remedied so that they will stay

remedied. We have now been trying to colonize these lands for the past four years and our work and trouble has largely been wasted by reason of causes which might have been prevented by proper appreciation and understanding of the requirements and necessities of the land

coloni-zation business on the part of those who were responsible for the local management in Prowers County. Of course we do not mean to say that the various people in charge out there during the past four years were

responsible fo~ such misfortunes as drouth and hail storms, but there has never been a time since we have commenced the colonization work when

the requirements of our settlers and the importance of the proper atten-tion to land seekers and to the preparaatten-tion of the land for the

efficient delivery of water to the purchasers has been appreciated. We are aware that a great deal has_ been done for settlers, and in some cases

they have been, in our opinion, over petted and over coddled; but not-withstanding all this when fresh lands have been sold, even as late as last fall, to new settlers they have been allowed to move on to their land and endeavor to raise a crop, while the Company has neglected the opportunities of placing itself in a position to fulfil its obligations to deliver them water.

We ought perhaps to have spoken thus plainly sooner, but we were not ourselves aware until recently what just cause for complaint our settlers had nor how serious was the handicap under which we were laboring in

endeavoring to colonize these lands. It looks now as if the best part of this season would be lost and as if many of our best agents

would become disgusted and quit. It is perfectly certain

thatit

would be nothing short of ridiculous to attempt at present to either raise

the price of the land or the water assessments,as -was recently suggested by the local management. The very fact of such a suggestion having been made at such a time simply shows that the Colorado advisers of the Company

were slumbering over a volcano which they apparently were unaware was in active operation at that very time. We fear that not only will coloniza-tion be greatly checked and that it will be impossible to raise the price of the land or of the water assessments but that in addition to all this the enterprise will have to stand the loss of the rebates which in our opinion must be made to settlers who have suffered by reason of the

negligence of the Company in carrying out its obligations to deliver water under its contracts. We regret such a state of affairs extremely, but

as they actually exist rather than to encourage you to continue looking

through rose colored spectacles at this enterprise.

enclose herewith copy of letter received this morning from Mr. Fred Mohl, our chief traveling agent, giving particulars of his last

trip to Prowers County which, you will see, was, considering everything, fairly successful. We wish to draw your particular attention to what he says about Mr. P . K. Hanson and the settlers at Amityville being so disturbed over the deley on the part of the legal department in preparing t he necessary documents to fix their legal status in connection with

their supplementary supply of water from the reservoir . We sent you yesterday copy of our letter to Judge Rogers upon thi~ ~ubj ect. · This

matter has now been hanging fire ever since last falI,nalthough we have repeatedly explained to the Colorado advisers of the Company the necessity for prompt action we s~em to utterly fail in securing any action, and so far as we can judge we are not much nearer now than we were six months ago to any definite settlement of thls matter which, in our opinion, can just as well be settled one tim~es nether. It is true that on Monday we received from Judge Rogers ad ft of a deed which could be used in the case of Mr. F.anson, but at same time he expressly withheld his

approval of a supplementary contract in similar terro~ to be issued to our other settlers and we felt that it would simply aggravate matters to issue a deed to Hanson and then perhaps subsequently attempt to issue deals or contracts to other settlers on a different basis.

The entire want of appreciation of the necessities and requirements of a successful colonization business on the part of the legal advisers of the Company in Colorado, and also of its local management in Colorado, is most discouraging to us in our attempts to work up colonization . We feel that we are handicapped by quite sufficient inherent and unavoidable difficulties without having our troubles increased unnecessarily by
