by The Great Plains Water Company. The total cost of this line ; as

mentioned~ $14,514.12 up to 31st August 1898, and your Com-1'

pany•s half will he $7,257.06. It. will in my opinion be better to carry this expenditure as an investment, to be written off in

equal annual installments during the next ten years. RESULT· OF THE BUSINESS.

In rggard to the rgsult set forth on the foregoing pages, I must ask you to bear in mind that, while the Expenditures in-clude all the expenses of maintaining the propert,y and conducting the business from Jul1~ 28,1897, to December lsq.898, a period of' sixteen months, during which period the canal has suffered several unforeseen anrl costly breaks, and during which period more than

$2900 has been expended on litigation, ~he Income is derived from only one small assessment or fifteen cents a share.

I would remind you too, that in my repor·t of last Spring I stated that there was a Deficiency or $6,076.00 on 31st of Dec-ember lR!n; Thus there has been no . loss in the year 1898 per se.

re-pairs, maintenance and operation of the Western Division of the Canal, namely from La Junta headgate to Gageby Division Gate, has been based on an estimate. submitted by the Superintendent of the Canal Mr. Porter Jr. Pres ton, as follows;

$6265.48, a shortage of $5,164.95.

I found in the voucher book three vouchers signed in blank by the Treasurer and five by the President. The signing of

these vouchers in blank, places the funds of the Company solely in the care of the Secretary and this is, in my opinion, contrary to the spirit of the By-Laws.

letter to Mr.Kebbler, the General Manager of the Colo.Fuel & Iron

Co., asking him to see that this bill was promptly paid. The bill was paid by return mail, we received a check. Mr.Kebbler wrote me a

personal letter and asked me to . see that the v-ouchers were properly signed and ~eturned to him at once. I handed this stuff into the Accounts Department. yesterda!, morning and have heard nothing from

it since,

----A man named Sherlock bought hay in the pasture of the

Sand Creek ranch, which was to have been paid for on November 1st.

About thirty days thereafter, Mr.Seward reported to Pettee that

there was a mistake in the measure, but Mr.Seward was unable to find th charge slip upon which the bill was turned into the Ac-countC! Depnr-·tment. Another bill was immediately made out. This as near as I can gather, was ten days ago. The bill has not yet been

sent to the man, and he has r·eported over· the telephone, besides having tOld me ersonally- that he was ready to pay the bill when-ever- it was presented to him.

Thee ~re .cases that exist to-day, now. The

conse-quences of this method of doing business, 1s that while you have

plant; of mo1ey here to- pay your bills and while we should get the b,nefit of the credit which the prompt payment of bills calls for,., the bills are not paid and our credit suffers, and that by the

in-attention of the Accounts Depar·tment, bills that are pa~rable to us are not paid because we do not send the bills out.

whom we ship hay, that they do not receive bills for their stuff. I must beg that you will take some means to have this state of affairs remedied.

Mr.Seward spends so much of his time trying to convince people that he is not subject to my orders or instructions, that he has very little time left to attend to his business.

I am sorry to worry you with this information, but it is absolutely necessary that something be done to remedy the conduct

of the Accounts Department. The specific charges which I shall make against him covering some space of time, will be made when I come

to

New

York.

It ma? be possible that if !rou write him a letter, tell-ing him in plain english, that his tenure of office here, depends upon the satisfaction which I get from his work, some change for

the better may accrue. In event that you write such a letter, I hope that

you

will send me a copy of it.

When I am determined to get anything out of the office on a certain date, it is necessary for me to make 5 or 6 and sometimes 8 andlO trips, and each trip there is always some reason whjch ,··Mr.

Seward has to offer, why he cannot do 1 t then and why he can do it. to-morrow or the day after. His position here as I understand it, is to assist me to conduct the business, instead of which he is a great deal more of an obstacle to the proper conduct of the business than he is an assistant.

Since writing the above, I have just come across a lease that has never been signed or acknowledged and also of a mortgage that is past due and which was never acknowledged before a notary.

If it had been the accountants business to have attended to these mortgages and leases, and he had failed to do it properly, it would be bad enough, but it is not his business to attend to any of these things • It is Mr.Montgomerytrs business and that fact is well known, but the desire of the accountant to keep things in his own hands, evidently prevented him from reporting the matter t,o Mr.Montgomenr or to me, and have either of us see that the papers

were in proper shape.

If I stated to you the cases that come up every few minutes at my desk, of the inef-ficiency of this department, I

would

be writine to you all day.

If

Mr.Seward's health is such, that he cannot attend to his business, I respectfully suggest that one, two, three or more

assistants be employed by him, so that our business can be properly

attended to.

The Governor and Attorney General being at the luncheon given to Mr .Hobson, a meeting of the Land Board could not be had this afternoon. I have howevt•r submitted for their considAration, re-solutions of which I enclose copies:

I told you in my letter yesterday that I had called Judge

Gabbert•s attention to his failu~e to dismiss the above case. To-day Judge Car.ripbell called my attention to the fact that a dismis sal

has sincP- been entered; Meeting Mr.Smith of Hughes office at the Capitol I told him that if they would abandon all the othe~ cases, I would agree that the Kreybill case might be reinstated. This may lead to a conference and I hope will result in getting rid of the purely obstruction cases.

Mr.Greene of Pueblo has just come in and I close this letter to talk to him.

I have your favor of December 2nd. The maintenance

charges for the Fort L1ron Canal last year were approxima tel:r $20,000

tel-ephone since receiving yo~r letter, and I cannot get it accurately. Our proportion of main ten ·nee for the past year, will be ver,.l small indeed and as you say, probably less than 25ft; I cannot however·

im-press upon your mind too s ongly the necessity that we must not deal with the Fort Lyon Canal Co. on a basis of our technical rie;hts. What I mean, is that we must ~_verythine; that we can to help them, up to the point of paying ~ke• or for them, actual cash.

The payment of this $1500 is expected by the Canal Co. now and has been for some time. The paying out of this money to them is not paying them what we do no~ or will not owe them, but is simply pa~ring it in advance and the payment of this money now will be of

thA greatest advantage to us ir our ability to cement the friend-ship between them and us, which is so absolutely important -1:o our interests.

is to control th~ whole five, and as this advance of mone:r costs us

There is another matter which had just as well bA taken up now as

When there is a br·eak in the Fo:r·t Lyon Canal , such as exists to-day, if they have no money on hand with which to repair

the break, we must bear· all of the expense instead of a portion of

it as I suggested in this case, and that expense must be born spot cash. Your· telegram rather leads me to under-stand that this does not accord with your views, and if it does not and you will not

telegraph me to that effect, I will stop all work on the break at Horse Creek flume , until the For·t Lyon Canal Co .. maR:e an assessment

and collect enough money to repair it, which will be some timA next

experience with irrigation work and his thorough knowledge of the

cost of moving di~t and running an outfit, will especially adapt him for this work.

Second. He is a Scotchman, with all of the canny Scoth

acqui-s"tiVene,

ability and inclin~tion to save money, and in this

par-t i cular he would be very valuable.

Third. An fmp;ineer· would be necessary in this enterprise in

any event. We would have to pay $125 to $150 a month to a good en-gineer to assist in the operation of our man!' water ways. By

con-tinuing Mr.Berry, we would only be paying $100 for an assistnnt manager, a nd would he securinr; the services and advice of an ane;i-nee r who can c ommand ~250 a month.
