A RESOLUTION AUTHORIZING THE PURCHASE OR CONDEMNATION OF CERTAIN LANDS ALONG THE SOUTH PLATTE RIVER BELOW THE CHATFIELD DAM.

WHEREAS, the Congress of the United States has authorized by Public Law 516, 8lst Congress (Flood Control Act of 1950), the con-struction of flood protection along the South Platte River between Chatfield Dam and Denver, Colorado, as one of the projects for flood control in the South Platte River basin; and

WHEREAS, the District Engineer, U.

Army Engineer District, Omaha, Nebraska, has formulated a plan of improvement which has been explained and discussed with local interests, and consists of levees and channel alterations along the South Platte River between Chatfield Dam and Denver, Colorado; and

WHEREAS, the Colorado Water Conservation Board recognizes that the plan will create substantial benefits through the alleviation of flooding and flood damages; and

WHEREAS, pursuant to existing federal law, the State of

Colorado must procure the necessary lands, easements and rights-of-way for the construction of the channel improvement between the Chatfield Dam and the City of Denver; and

WHEREAS, pursuant to 149-1-11(11), Colorado Revised Statutes 1963, as amended, the Colorado Water Conservation Board is authorized to purchase or acquire by eminent domain any real property or interest therein with respect to any project specifically authorized by the United States Congress for the prevention or control of floods; and

WHEREAS, during the years 1969 and 1970, the Colorado Water Conservation Board caused an appraisal to be made of the lands required

for channel improvement as a part of the Chatfield Flood Control Project, which appraisal was made by the Frederick R. Ross Company, qualified

WHEREAS, since such appraisal was made, the lands so appraised have been designated and zoned by the proper local authorities as being within the flood plain of the South Platte River, thereby limiting the use of said lands and decreasing the value thereof to more than offset any increase in value which has occurred since the appraisal was made: and

WHEREAS, the Colorado Water Conservation Board believes that the appraisals made by the Frederick R. Ross Company are equal to or exceed the fair market value of the lands which must be acquired as a part of the Chatfield Flood Control Project, and therefore the Board believes that the appraisals constitute just compensation for the lands

to be acquired:

NOW, THEREFORE, BE IT RESOLVED by the members of the Colorado Water Conservation Board in regular session assembled at Denver, Colorado

this 18th day of January, 1973, that the Board does hereby approve the appraisals prepared by the Frederick R. Ross Company on the lands along the South Platte channel below the Chatfield Dam to be acquired as a part of the Chatfield Flood Control Project, and the Board does further reasonably believe that such appraisals constitute just compensation for the lands so appraised and to be acquired: and

BE IT FURTHER RESOLVED that the Director of said Board is hereby directed and authorized to offer to purchase and to purchase the following numbered parcels of land situated in Arapahoe County, Colorado which are required to complete the authorized channel work on the South Platte River for approximately seven miles immediately below the

Chatfield Dam, at the appraised purchase price indicated hereinafter for each parcel together with damages to the remainder, if any, to-wit: Parcel No. 8 Owner of Record: Mrs. Earl

BE IT FURTHER RESOLVED that in the event any owner or owners of any of the parcels enumerated herein reject the offer of compensation herein authorized, then the Director of this Board, through and with the consent of the Attorney General, is authorized and directed to proceed with condemnation proceedings in the manner authorized by law; and

BE IT FURTHER RESOLVED that a true and correct certified copy of this resolution be furnished to the Attorney General of the State of Colorado and to each of the landowners named in this resolution, or to their successors in interest.
