THE AMITY LAND eeMPANY.

Th e Holly Ranch Irrigated Farm ing Land

J:vir.

W. M.

Wiley,

Holl:,, Colo.

Dear Sir:

HOLLY, PROWERS CO., COLO.,

Denver, Colo. Dec. 7,1896

W . M . WILEY, Manager E. C. HAWKINS, Chief Engineer THOS . BERRY , Engineer in C harge

I

havA just had a long talk with Col. Carr about the

sale of school lands,

and

hA is firmly convinced that this will

be

the last and only chanc~

to dispose

of the same.

He is

heartil:

1

in

favor of the sale, believing

it

to be for the best interests of the

school funds,

but

he sa?s so:r.1ethin3

must be

done to satisf~r the

Governor. It

seoms

the Governor is equally desirous of makin.ti the

sale, believing it is the only proper thing to do, and

yet he feels

that some concession should be made

by

us in the matter of selling

water to others under

the

line of canal.

Col.

Carr sufmests

a

pro-v is ion, which,as he frankly admits, is nothine more or less than

what the law already provides, that ;ou shall aeree that after you

have applied all the water upon the lands owned and to be acquired

by

you, the surplus may be acquired

by

others, uponterms and

con-ditions to be fixAd by the proper authorities. With some such

ar-rangemAnt, he says the Governor will approve the sale/

To

put the matter in brief, the Colonel said that the form

might be

such

as

in

mJ judgment

would.

be

agreein[~

to do no more

than

we

are already obligated under

the

Statute

to

do.

I

have

filed all of th0 petitions from Lamar concerning the sale with the

RegistPr of the Board. These petitions should be sent direct to the

Board and not to me. Let me know about ~he Colonel's proposition

at once.

Very sincerely yours,

(30)

Mr. W. M.Wiley,

Holly, Colo.

My

Dear

Mr.Wiley:

THE AMITY LAND C8MPANY.

HOLLY, PROWERS CO., COLO.,

Denver, Colo. Dec. 5,1898.

W. M. WILEY, Manager E. C. HAWKINS, Chief Engineer THOS. BERRY , Engineer in Charge

In enclosing Judge Nowell's letter to the r~gister of the

land board, I accompanied it with a letter- a copy of which is

here-wth enclosed.

I have

also

wr-i

tten to Col. Carr·

of

the land board

calling his attention to thA recent decision of the Circuit Court

in

the United

States for· the

district

of

Montana, which disposes of

all questions about your·

rieht

to carry water into Kansas.

I

have

not

heretofor·e called :,ouJt>· attention to this case as

1

t

was

only

reported

in the 8'9

Federal Repor·ter,

on

November 22nd of this year.

It holds that state lines are not to be regarded in r~spect to

ap-propriation for purpose of irr~eation.

I went a f~ain at noon

to-day

to see Alderman Newt;on, chairman of

the Committee appointed

by

the F.O.S. of A., in connection with the

sale of school lands, and was surprised to hear from him that the

Committee met on Frida:, last nd had a.greed to do nothing except

enter a genera l protest. I priesume the f1overnor· will be afraid to

act with out the approval of the P.O.S. of A. This unintel ligent,

uninformed protest, can be considered to mean nothing more or less

tha n an objection to any dealings with any outside capital or even

h ome capital, so far as that is concerned, lookine toward the

dev-elopment of Colorado. I have tried from time to time to do what I

could for the State and have endeavored at all times to keep its

interests in view, but if the people concerned have no care in

that direction, I shall have to revise my sentiments and determine

whether I have any.

What, if anything has been sent to the Board from the

citi-zens of Lamar? As you know, they meet on Wednesdo.y at which time we

ought to ha,,e some disposition of the matter·.

I unde~stand the Farmer's Meeting was satisfactory all

round, and that Lamar will be a unit at the comine annual election

of the Fort Lyon.

Very sincerely yours,
