I have just returned from Frank.fort,where I had been attonding
court in
connection
with the suit vs.the Register
of Land Office andAsher about the Cheever patent. Though r~ady fer trial and anxious to
secure it,I was again unable to do so. The judge was not at all vell
and could not work at night,howover wi l_ng~ and the trial of jury
m.at-ters in state cases took up all available time by day. He has agreed
to try the case at night at icxt torm, beginning first Monday in April~
and says he will do all in hi that time.

-We have yours of 25th and in accordance t herewith have stricken out Judge Rogers' statement that Amity purchasers get a supply of water "whenever the same is needed ." This statement was not modified or qualified in any· way and with t h e context would in our opinion amount to a guarantee, wh ile our statement that the farmers never suffer from
drought is at t h e most a 1.f1ere rep1 .. esentation which could in no way render the Company liable .
Your letter leaves us pretty much where we were as regards future
colonization work , except for an undertaking to make Mr . Wiley different from what he is, which we fear is m.ore of an undertaking than you imagine.
On the other hand, we t hink you o:verestimate the diffi~ulties of manaeing an irrigation enterprise . ,Other enterprises of' like nature have been successfully managed and c-0lonized and there is no spefi al difficulty inherent in the i ty . ,iAll that is wanted is a good Ditch and Reservoir manager , the a oidan. ·e of fads and experiments and
reasona1)le treatment of the loni·' ts .
You seem to t ~1ink t hat i we , were to sell 20000 acres in one season it would be impossil)le o ·furnish all the water that would be required . But no t over half t l ·s acreage would be set t led upon and i m-proved t he first season and if he Amity under proper management cannot furnish this much water the money that has been spent on it has been wasted .
The re is no use in our aeen ts s :pending t... e i r time in working up men and taking them out under existing conditions, and they cannot afford to do so . TheJ are simply losing their time and expenses and earning no co111t'11ia;ions . As we pointed out in our previous letter, the scale of comn issions is based on an agent being able to sell to at least 75

of t e men he takes out . In order to hold our agents under the existing conditions it would be necessary to guarantee their expenses and guaran tee t hem a reasonable remuneration . It would in our judgment oe throwing money away to do t h is while things in Prowers County remain as they are and have been for some t i me past . Vlhen the new ·Nater deed is put in force it will be even 1 ore useless to take land seekers out tban at:present . We gather that it is proposed to put the new deed in force at an early date . ].tlr . .. J oh l is here to-day and we have conferred with him
on the subject and h e says t hat v1hile it migh t be :possible to raise the via ter assesmnent to fifty cents per acre for t he future to cover mainte-nance o:f Amity Canal, Reservoirs and main laterals, the other features
remaining the same as at present, it would be useless to attempt to sell land on the basis of two acre feet to be delivered at t he pleasure of the Corr1pany as proposed under Judge Rogers' new water deed . He says t hat the f ~eling amongst the existing settlers towards t h e local management is so distrustful and hostile that they would tell new land seekers that if they
ere only to get water at the plea.sure of the Company their chances of et ting it woul<1 be slender indeed . Judge Rogers does not appear to realize that h is ideal sche~e for a benevolent despotism is dependent for success upon the implicit confidence and good-v1ill of the settlers and that he and Mr . Wiley have unfortunately forfeited t h is and created in its place the deepest distrust .

-2-There does not seem much use in further discussing the "whys and wherefores" but rve are confronted with this condition that unless you
are willing to guarantee expenses and remuneration agents will not go on
working under existing conditions, and still less when the new water deed
is put in force .
We have already lost a number of good aeents and others are so
disgusted that they vdll not continue another season . One agent who
has :nen ready to take out won ' t take them as he says it is only throwing
away his time and money . I t seems to us that in these circmnstances i t
is for you to decicle whether you prefer things to remain as they are or
to put me .. tters on such a footing as will enable colonization work to
pro-ceed . In order to do this it will be necessary ,
(a ) To aGree upon such terms and conditions of sale , including
water deed, as will be permanent and attractive instead of
repellent to purchase rs .
(b ) To establish such local management as will assist i nstead
of obstruct sales ancl will have the confidence and good-wi ll of the settlers .

Sir:-In the statement of the Geo. V. Turner account just received from you appears a credit i tern "November 11 by Juni ty draft, $226 . 49 . n
Will you kindly advj_se u.s from what ac,count this credit is received? We have received no statement from Holly showing any such credit and we
have no means of knowing w~re the credit should be given . We would
also caJl your attention to \ ome apparent e·rrors in Mr . Wiley's account .
In the statement of this acco1'1t r 1rnished under date of July 19 appears
a charge to Mr . Wiley of $148 . ~ J whereas the corresponding item in the

Turner account shows a p _.yment of $140 . 84, an apparent differenceof $8; also in the subtraction at the bottom of this statement there is an
error of 10 cents . The amount to be carried forward should be $374 . 05
instead of $373 . 95 as per statement. If these two errors were corrected
they wonld make the balance of :Mr . Wiley's account of 1{ovember 1, instead
of $283 . 66 as per the statement, to be $275 . 76, which is the balance on
the books of the Amity Land Co . The statement of Mr . Wiley ' s account
which we have just received starts with a balance of $263 . 66, a difference
of $20 less than the amount with which your statement of November l
cl oses . Vii th this correction and the other items to which we have
called your attention we make it that the balance of Mr. Wiley's account
