Samfällighetsutredning med förslag till förändring

Sammanfattning
Vi fick vårat examensarbete genom en bekant som behövde hjälp med att utreda en samfällighet. En samfällighet är ett mark- eller vattenområde som ägs gemensamt av flera fastigheter. Samfälligheten som vi fått i uppdrag att utreda, äger hans moder andel i och han är dessutom ägare till hälften av en fastighet som angränsar till denna samfällighet. Vi fick även i uppgift att ge förslag på hur han skulle kunna göra för att använda samfälligheten i eget syfte t.ex. arrende eller fastighetsreglering.
En samfällighet kan ligga orörd i många år och ägarförhållandena kan ha fallit i glömska.
Det är inte förrän den blir inblandad i ett lantmäteriärende av något slag som detta blir utrett. Det man först måste göra är att ta fram de akter som hör till ärendet. Man utreder ägarförhållandet som det såg ut vid den tidpunkt det tillkom. Man går därefter vidare och undersöker om det har hänt något med de berörda fastigheterna som t.ex. att de har blivit uppdelade genom arvsskiften men de kan även ha blivit förändrade genom olika förrättningar.

Summary
We got this work through an acquaintance who needed assistance investigating a piece of common land. Common land is an area of firm ground or water, which is owned jointly by several properties. This particular domain, that we are investigating, is partly owned by his mother. He is himself joint owner of a property that is adjacent to this piece of common land. We were also given the task of making a proposal on how he could use the domain for his own purpose, e.g. leasehold or regulation of real estate.
A piece of common land can stay untouched for many years and the state of proprietorship might be forgotten. This will not be made clear until the land is involved in some kind of survey. The first thing to do is to bring out all documents relevant to the case, and investigate the ownership at the time the common land was created. After that one need to find out if something has happened to the adherent properties, e.g. if they have been divided through distribution of an estate or been changed by other official duties.
