I am enclosing herewith the Detailed Outline of Kansas Rebuttal Testimony in accordance with the schedule agreed to on June 18 during trial.

: The exhibits and backup provided to you two months ago (Plaintiff's j xhibits 689-698) will be relied upon for purposes of this testimony. I am enclosing a modified version of Plaintiff's Exhibit 692 which has been modified to indicate that it applies to Reach 4 only. There is one additional exhibit, Plaintiff's Exhibit 705, which is enclosed with its computer backup.

We have attempted to be very detailed in the description of the testimony to be presented by Kansas on rebuttal. I am sure that you, as you indicated at trial, will be equally detailed in your description of the Colorado surrebuttal testimony.

I currently estimate that the direct testimony on rebuttal will requ re approximately one and one-half days. If cross-examination is equal in length, e might be finished with the Kansas rebuttal case by the end of Wednesday, · ~

September 23. Following the trial week of September 21-25, we are presently scheduled to break for two weeks because of a trial in which Mr. Spronk is involved.

Dennis inquired during our conference call with the Master last week whether there has been any postponement of Mr. Spronk's other trial that would allow us to continue this trial the week of September 28. I have checked, and at the moment the other trial is still scheduled to begin September 28. However, a motion for continuance has been filed in the other case and is pending. I will inform the Master and the parties immediately if the other trial should be continued.

Thank you for your letter of yesterday regarding the trial schedule. Although the courtroom availability is not ideal, we do want to resume trial on February 24 and continue throughout that whole week, using the other courtrooms as necessary. I

would also suggest that where other scheduling difficulties exist with respect to Court Room 3, that we utilize one of the other court rooms whenever possible so that we can keep as close to the schedule as possible.
