: The exhibits and backup provided to you two months ago (Plaintiff's j xhibits 689-698) will be relied upon for purposes of this testimony. I am enclosing a modified version of Plaintiff's Exhibit 692 which has been modified to indicate that it applies to Reach 4 only. There is one additional exhibit, Plaintiff's Exhibit 705, which is enclosed with its computer backup.
We have attempted to be very detailed in the description of the testimony to be presented by Kansas on rebuttal. I am sure that you, as you indicated at trial, will be equally detailed in your description of the Colorado surrebuttal testimony.

I currently estimate that the direct testimony on rebuttal will requ re approximately one and one-half days. If cross-examination is equal in length, e might be finished with the Kansas rebuttal case by the end of Wednesday, · ~
September 23. Following the trial week of September 21-25, we are presently scheduled to break for two weeks because of a trial in which Mr. Spronk is involved.

I will inform the Master and the parties immediately if the other trial should be continued.

Thank you for your letter of yesterday regarding the trial schedule. Although the courtroom availability is not ideal, we do want to resume trial on February 24 and continue throughout that whole week, using the other courtrooms as necessary. I
would also suggest that where other scheduling difficulties exist with respect to Court Room 3, that we utilize one of the other court rooms whenever possible so that we can keep as close to the schedule as possible.

ACTUAL COURT ROOM AVAILABILITY February 24, 25 and 26. Court room 3 is not available on 27 or 28. It would be possible to use Court Room 2 on February 27th, and Court Room 1 on February 2 8 , if we wanted to make the necessary moves.
March 9, 10, 11, 16, 17, 18 and 20. (Not available on March 12, 13 or 19)
Available on all days. Available on all days.
Not available on May 25, as it is a holiday. Available on 26, 27, 28 and 29.
Available June 15, 16, 17, 19, 22, 23 and 24. Not available on June 18, 25 or 26.
I had not intended to put all of the dates in my Order, only the return date of February 24. Please let me know whether you still want to resume the trial on that date.
It may be possible to use Court Rooms 1 or 2 on some of the other days when Court Room 3 is not available. We have not checked that. I expect that space would also be available in July, if that becomes necessary, but again we did not inquire about that possibility.
