Enclosed is a proposed subscitute bill for S. 2117 which
Senator Armstrong introduced on December 11, 1979. We believe
chat the language contained in this substitute bill will accomplish
all the objectives of

2117 and also of H.R. 5199, witho,!t so~,~of the objectionable features of th0se C'? bi::.J.s.
We have contacted our counterparts in the other six Colorado
River Basin states and they all endorse this substitute bill. They
are in the process of contacting their respective senators with the
objective of having all of them simultaneously named as co-sponsors
when this new language is introduced. This will be in line with
the precedent set by the bill for the original Colorado River Basin
Salinity Control Act (P.L. 93-320) which we are amending. This
original bill was supported upon introduction by 35 reprcsen~atives and all 14 senators of the Colorado River Basin States.

IN THE SENATE OF THE UNITED STATES
introduced the following bill; which was read twice and

A BILL
To authorize certain additional measures to assure
accomplish-ment of the objectives of Title II of the Colorado River Basin
Salinity Control Act and for other purposes.
Be it enacted by the Senate and House of Representatives of
the United States of America in Congress assembled, That the Act
of June 2~, 1974 (88 Stat. 266), the Colorado River Basin Salinity
Control Act, is hereby amended as follows:
SEC. 1. (a) After the word "units" in the first sentence of
Section 202, insert a comma followed by the phrase, "including
measures to mitigate losses of habitat for fish and wildlife
related thereto,"
(b) In the second sentence of paragraph (2) of Section 202,
after the comma following the clause, "Measures shall include
lining of canals and laterals," insert the phrase, "placing canals
and laterals in pipe,"
(c) In the fourth sentence of paragraph (2) of Section 202,

those lands that participate in the Department of Agriculture programs to improve on-farm water management shall receive such assistance."
(d) Before the beginning of the first sentence of Section
202, insert the indexing symbol "(a)". At the end of Section 202, add a new paragraph to read, "(b) From time-to-time, as the
Secretary may find appropriate, the Secretary shall review the
plans for implementation of the units authorized by this section, and, based upon his findings, shall make recollllllendations to the
appropriate committees of the Congress regarding the desirability
of continuing to implement such units or portions thereof. The
Governors of the Colorado River Basin states shall be notified of
such recommendations."
SEC. 2. In paragraph (b) of Section 208, following the second
sentence, insert the sentence, "The funds authorized to be appro -priated by this section may be used for construction of any or all of the works and for other purposes authorized in Section 202

-0f this title, or for portions thereof: Provided, However, thatnot more than. 5 percentum of the cost of constructing any salinity control unit authorized by Section 202 of this title may be
expended to mitigate losses of habitat for fish and wildlife related to implementation of that unit."
