Keep in mind that

In order to buy the freehold of a site-leasehold, all mortgages and contractual rights (easements and rights of use) valid in the site-leasehold must be cancelled. The site- leasehold can then be removed and we can grant registration of title to the property.

When the mortgages are extinguished, you can choose to take out new mortgages that are then granted in the property. Registered contractual rights can also be re-

registered in the property.

• Copies of registered contract easements and/or rights of use must be enclosed with the application and the right holder must certify that the rights may be extinguished in the site-leasehold. If the rights are to be re-registered, the owner of the property must grant their consent.

• All mortgage certificates to be cancelled must be submitted together with the application.

o Hard copy mortgage certificates must be sent with the application. Please re- member that a hard copy mortgage certificate is a valuable document and you should therefore send your application by recorded delivery.

o Digital mortgage certificates must be transferred to the Property Registration’s archive. If the digital mortgage certificates are pledged, you must contact your bank/lender. If the digital mortgage certificates are not pledged and are in the Owners Archive, you may submit a request for them to be moved. You use the Digital mortgage certificate form – move from the Owners Archive to the Land Registration Division – request.

o If you do not know whether your digital mortgage certificates are in the Owners Archive or at your bank/lender, you can, as the owner of the site- leasehold, request an excerpt from the mortgage registration system showing where the mortgage certificates are located. The excerpt can be ordered via agarfragor@lm.se

• The original acquisition document must be enclosed.

• If you want to take out new mortgages in the property and you are a married or a registered partner, you must also enclose:

o consent from your spouse/partner or

o document showing that the property is separate property, for example a deed of gift or will providing this.

• If the application or the acquisition document was signed under a power of attor- ney, please enclose the original power of attorney.
