Abstract
The Sami people is an indigenous group in Sweden that has historically been treated badly by the Swedish government. Forced relocations, colonization and cultural assimilation are examples of actions which the Swedish government has applied on the Sami people. Even though some believe that the state discriminations against the Sami people by the state are in the past, the Swedish government still to this day is criticized for how they handle the rights of the indigenous people.
Based on the criticism that the Swedish government constantly receives regarding the respect of indigenous rights and specifically Sami rights, this essay aimed to examine the state’s obligations against these rights by doing a critical text analysis. The first aim of this study was to present the obligations that Sweden has agreed on by international conventions, specifically through United Nations Declaration on Indigenous Rights (UNDRIP). The second purpose was to examine how these obligations were implemented in two municipalities in Sweden, Jokkmokk and Kiruna. The third and last purpose of the study was to critically review the management of these three rights by the Swedish government applying a theoretical framework based on Will Kymlicka’s theory on minority rights and Seyla Benhabib’s theory on multicultural and deliberative democracy. The study shows that both Jokkmokk and Kiruna needs to improve their management of indigenous rights specifically regarding the right to self- determination and the right to land.
