INTERROGATORY NO. 1. Identify the person(s) answering or providing assistance or information in answering these

interrogatories, and identify the interrogatory or parts thereof answered by or for which assistance or information was provided by each person.

ANSWER TO INTERROGATORY NO. 1. Harvey J. Johnson, President of Water Supply and Storage Company, assisted by Ward H. Fischer, attorney for the Company.

INTERROGATORY NO. 2. Have you or your attorney or anyone else on your behalf, contacted or consulted any person as an expert or consultant in any field in any manner whatsoever with respect to this case (this includes any person employed by your attorney to assist in the preparation of your case, whether that person is or is not now expected to testify at trial}? If so, state as follows:

(a) The name, address, occupation and field of expertise of each such person contacted or consulted;

(b) The date of the first contact or consultation with that person, and the name of each person contacting him or her on youc behalf;

(c) The dates of all subsequent contacts, meetings, or consultations with that person and the name of each person

contacting the consultant on your behalf and the names of all persons pcesent at such contacts, meetings or consultations;

(d) Identify any written or oral reports or both which were made by the consultant oc person contacted;

(e) As to each such report, state whether it was written or oral;

(f) As to each such report, state whether it was

pursuant to employment in an advisory capacity, as a prospective witness, or both;

ANSWER TO INTERROGATORY NO. 2. Yes. The attorneys for the Water Supply and Storage Company have worked closely with the attorneys and staff of the Northern Colorado Conservancy

District, and with the attorneys for the State of Colorado, and with attorneys for others in this case. The State of Colorado has retained Simmons and Li to assist them on the technical aspects of the case, and have allowed the attorneys for the Company to consult with various members of the firm of Simmons and Li, and with those to whom Simmons and Li have subcontracted certain work. The State of Colorado will furnish the requested information concerning those persons, and such information will not be repeated in this answer, as it would be duplicative. In addition to those persons the attorneys and the Company have worked closely with John Scott and John Altenhofen of the

Northern Colorado \vater Conservancy District, and they in turn have spoken with Charles Leaf. They have done so as attorneys for the Cache La Poudre Water Users Association. That

Association has also retained Dr. Everett Richardson to advise it. Specific information concerning consultants advising the Company and other members of the Cache La Poudre Water Users Association is as follows:

John Scott and John Altenhofen

(a) John Scott and John Altenhofen, Northern Colorado Water Conservancy District, Loveland, Colorado. They are

engineers and hydrologists, and are on the staff of the Northern Colorado Water Conservancy District.

(b) The date of first contact or consultation was a year to a year and a half ago, and they were contacted by Ward and William Fischer, our attorneys.

(c) They have had continuing meetings and consultations.

(d) ' (e) and

(f) No reports of such have been issued, either orally or in writing. These gentlemen serve as continuing consultants, advising the Company as well as the District concerning their

rights, means by which injury might conceivably be avoided (such as moving quantification points) and the like. Thus far they have served in an advisory capacity, but they may ultimately be witnesses.

(g) These gentlemen have visited some sites, obse~ved

certain quantification points, made some measurements and did some calculations in the field.

(h) We have not yet determined whether to call these consultants as expert witnesses.

(i) We should have made a determination as to whether or not these gentlemen will be expert witnesses by December of this year, or earlier if the pre-trial conference is earlier held.

Charles Leaf

(a) Charles Leaf, Marino, Colorado, forester and hydrologist.

(b) Mr. Leaf was first contacted by John Scott about the week of August 22.

(c) It is our understanding that Mr. Scott will again meet with Mr. Leaf, but the date that he will meet is not known to us. (d) None. (e) None. ( f ) None. (g) Not applicable. (h) Unknown. ( i ) December 1988. Everett Richardson

(a) Dr. Everett Richardson, 824 Gregory Road, Fort Collins, Colorado, engineer, hydrologist, geomorphologist.

(b) Dr. Richardson was initially contacted sometime in 1985.

(c) As attorneys for the Cache La Poudre Water Users Association, our attorneys have had numerous meetings with Dr. Richardson, sometimes with other attorneys and with John Scott and John Altenhofen, and sometimes with the staff of Simmons and Li, and those to which Simmons and Li has

subcontracted certain work. It is impossible for them to

remember the details concerning the dates or the persons present at such meetings.

(d) None.

(e) Not applicable. (f) Not applicable.

(g) Dr. Richardson is investigating the propriety of the methodology contained in Chapter 30. His investigations have included visits to the field, research in technical journals and discussions with Simmons and Li and others.

(h) We expect the Association to call this consultant as an expert witness at the trial, but we may also do so.

INTERROGATORY NO. 3. As to any of the consultants named as prospective witnesses in the immediately preceding interrogatory, state as to each such witness who is expected to testify at the time of trial:

(a) Name of prospective expert witness;

(b) The subject on which the expert is expected to testify;

(c) The substance of the facts to which the expert is expected to testify;

(d) The substance of the opinions to which the expert is expected to testify; and

(e) A summary of the grounds for each such opinion. ANSWER TO INTERROGATORY NO. 3.

(a) Dr. Everett Richardson.

(b) Hydrology and geomorphology.

(c) The witness is expected to say that the flows claimed by the United States are not needed to accomplish the purposes claimed by the United States; and that reservation of water for such purposes would result in injury to existing water users. He may testify as to other matters.

(e) We have not consulted with the witness in depth, nor has he so sufficiently completed his investigations, as to allow us to give more detail concerning the nature and extent of

INTERROGATORY NO. 13. Identify all documents which you have examined in order to determine or which may relate to the meaning of the phrase "securing favorable conditions of water flows" as used in the Organic Administration Act of 1897, 30 Stat. 34 (1897), and specify the page number of the material so ~elied

upon.

ANSWER TO INTERROGATORY NO. 13. The term "securing favorable conditions of water flows" can be defined only be ~eading the legislative history of the O~ganic Administration Act of 1897, and the cases of state and federal courts dealing with reserved rights. There may be other material, not yet discovered, which will be a further aid in defining the phrase.

INTERROGATORY NO. 14. Have any of the points of

quantification identified in the amended applications filed on November 3, 1984, adversely affected your absolute or conditional water rights, and if so, for each such water right:

(a) Identify the point of quantification: (b) Identify the water right:

(c) Describe the nature of the injury to or adverse effect upon the water right.

ANSWER TO INTERROGATORY NO. 14. Quantification points do not adversely affect water rights. What adversely affects water

rights is the inability to divert or impound water because of a claim by the United States for instream or other flows.

In further response, however, we are informed by the Forest Service through your office that the only quantification point

that appears to directly affect the Company's water rights is the one on Trap Creek which is adverse to the Company's conditional decree for Trap Lake II Rese~voir located in Section 2l-T7M-R75 W of the 6th P.M. in Larimer County, priority date June 16, 1982 •

These interests include irrigated and rain-fed agriculture, watershed management, on-farm water management, water resources planning, water and sediment measurement in natural streams, bridge waterways, sedimentation, water delivery and drainage systems and international development.

1949-53 Hydraulic Engineer, U.S. Geological Survey, Riverton, Wyoming.

Installed and operated water and sediment measuring station to collect the basic data for the Wind River Basin Study of the Missouri basin plan. Designed and help construct total sediment discharge measuring (suspended and contact load) stations on Five Mile Creek. Data used to develop the Modified Einstein Sediment Discharge Equation.

Engineer in charge of Chemical and Sediment Data Collection Program 1951 and 1952.

Conducted field studies on diffusion characteristics of the Colorado River and Missouri River; resistance to flow and sediment transport on the Rio Grande, South Platte River, and Missouri River; dye dilution measurement techniques; movement of radioactive particles in lower Columbia River; scour at bridge crossings and encroachments.

Conducted laboratory studies of sediment transport and resistance to flow in sand channels, model studies of water and water and sedinrent measuring flumes, and turbulent characteristics of open channel flow. Produced movie, "Flow in Alluvial Channels."

In this program worked with counterparts at Utah State University, Ari?ona University, University of California at Riverside, and Oregon State University in developing research programs and response capability at our universities in the fields of Agricultural and Civil Engineer in'], Agronomy, Economics, Sociology, etc., for use by USAID and other development agencies such as F AO and World Bank. As an outgrowth of this activity helped establish the Consortium for International Development which now has eleven western universities cooperating together to furnish technical assistance to the developing world.

Campus Director of CID's Egypt Water Use and Management Project (EWUP) sponsored by USAID (1977-84). The 13 million dollar contract was to conduct a Water Management Research Program in Egypt to increase the socio-economic conditions of Egypt's farmers by improving on-farm water management. The project is interdisciplinary utili7.inrJ the disciplines of Engineering, Agronomy, Sociology and Economics.

Professor-In-Charge of the Hydraulics Program (1983 - __). Working with other Civil Engineering faculty in the program, conducts basic and applied hydraulic research in the general fields of hydromachinery, transients, sedimentation, river mechanics, irrigation, hydraulic structures, hydromechanics, highway hydraulics, scour and erosion, and working with the faculty organizes the undergraduate and gradu<tte courses for hydraulic majors. Working with the Director of the Hydraulics Laboratory coordinates the use of the facility by the other faculty members in the hydraulics program. The facility has a 280x l ?.0 foot laboratory' 1

Agriculture Experience

1949 Raised and worked on the family farms and ranches in the Nebraska Panhandle. This included irrigation and dryland farming with both cattle feeding and ranching. Total areas involved were over 960 acrec: irrigated, 2400 acres dryland wheat, and 2000 acres in range. Crops were SIHJ<if

beets, hay, corn, dry beans, wheat and small grains. Did everything from thinning beets to running a combine.

1949-68 Not directly involved in farming but worked with U. S. Geological Survey involved in measurements of water and sediment from small watersheds and farms in Wyoming and Iowa.

1968- Conducted research on water management to improve irrigation efficiency, water qunlity, on-farm water management, hydraulic structures for conveyance and measurement of water, l~!t_pl and management constraints to irrigated agriculture in the developing world and river response to development.
