At the time the Memorandum of Agreement was agreed to and signed for the 1976, 1977 and 1978 Sugar Beet Contract, paragraph 1 of that Agreement stated that terms, provisions, and conditions of the 1976 contract would remain the same as the 1975 contract. Included in that category was the provision relating to the "Minimum Sugar Content Guarantee" or Paragraph 5(e) of the 1976 contract, and the intent
was to have that clause function in the same manner as in 1975.
During the drafting of the 1975 contract paragraph to fit a three-year concept, the words "prior year's" and "prior two year's" were inadvert-ently added and escaped notice where the provision begins with "• •• in the case of (i) ••• " and ends with " ••• average."
To maintain the intent of the Agreement and operation of the provision in Paragraph 5 ( e), the paragraph should read as follows: "• •• in the case of (i), the higher of either the actual percent or a level 1

degrees of polarization below the current year's (applicable district) average and, in the case of (ii), the higher of either the actual percent or a level 2 degrees of polarization below the current year's (applicable district) average."Association Presidents Page Two
