To authorize the Secretary of the Interior to construct, operate, and maintain the Collbran reclamation project, Colorado, ai;id to provide for disposition of the project upon completion of repayment.

1 Be it enacted by the Senate and I-louse of Representa-(; 2 tiues of the United States of Ame1·ica in Congress assembled, 3 That, for the purpose of supplying water for the-irrigation of 4 approximately t,Yenty-one thousand acres of land and for 5 municipal, domestic, industrial, and stockwater uses and of 6 pro5ucing and disposing of hydroelectric power and, as inci~

7 dental to said purposes, for the further purpose of providing 8 for the pre erYation and propagation of fish and wildlife; 9 the Secretarv of the Interior is authorized to construct the 10 Collbran reclamation project, Colorado, substantially m

13 SEC. 2. In constructing, operating, and maintaining the

14 Collbran project, the Secretary shall be governed by the

15 Federal reclamation laws (Act of June 17, 1902, 32 Stat.

16 388, and Acts amendatory thereof or supplementary thereto) ----.:.__..__._ except so fa as these laws are inconsistent with this Act:

18 Provided, That any contract entered into pursuant to

sub-. 19- section ( d) of section 9 of the Reclamation Project Act of 20 1939 ( 53 Stat. 1187) may provide that the general

repay-21 ment obligation shall be spread in annual installments, in

22 number and amounts satisfactory to the Secretary, over a 23 period of not exceeding fifty years, exclusive of any develop-24 ment period as therein provided, for any project contract 25 unit or for any irrigation block, if the project contract unit

11 notwithstanding any provision of law to the contrary, net

12 revenues derived from the sale of commercial power and

13 from the furnishing of water for municipal, domestic, and

14 industrial use shall be applied, first, to the amortization, with

15 interest, of those portions of the actual cost of the

construc-16 tion of the project which are allocated, respectively, to

com-17 mercial power and to nici al, do'!}'l,estic, and industrial

18 wa er supply; and, thereafter, shall be applied to

amortiza-19 tion of that portion of the cost allocated to irrigation which

20 is beyond the ability of the irrigation water users to repay

21 wi.thin the period specified above. Amortization of that

22 portion of the construction cost allocated to commercial

23 power shall include interest on the unamortized balance

24 thereof at 3 per centum per annum. Repayment of that

1 is allocated to municipal, domestic, and industrial water

rate ( which rate shall be certified by the Secretary of the

-4 · ·T1·easury) equal to the average rate paid by the United .5 · States on its long-term loans outstandin.(J at the time the 6 repayment contract is negotiated minus the amount of such

7 net revenues as may be derived from temporary water sup-8 ply contracts or from other sources prior to the close of the 9 repayment period, shall be assured by a contract or contracts 10 , satisfactory to the Secretary, the term of which shall not

[1 exceed fifty .Jlears from the date of completion of the municipal I I

12 and industrial water , supply features of the project as 13 determined by the sJcretary.

14 SEO. 3. There are hem by authorized to be appropriated~

15 out of any moneys in the Treasury not otherwise

appro-16 priated, approximately $16,086,000 to carry out the

pur-- pur-- pur--~7 11oses of this Act.

18 SEO. 4. This Act and all works constiucted nereunder

19 shall be subject to and controlled by the Colorado River

20 Compact dated November 24, 1922, and proclaimed effective 21 by the President June 25, 1929, the Boulder Canyon Proj~

22 ect Act approved December 2, 1928, the Upper Colorado

23 River Ba in Compact dated October 11, 1948, and the

24 · · Mexican vVater Treaty, and no right or claim of right to the

1 use of the waters of the Colorado River shall be aided or

2 prejudiced hereby.

Amend the title so as to read: "An Act to authorize the Secretary of the Interior to construct, operate, and main-tain the Collbran reclamation project, Colorado."
