belonging to the United States, and f01' the purposes, among others, of regulating the flow of the Colorado River, stor-ing water for beneficial consumptive use, making it possible for the States of the Upper Basin to utilize, consistently with the provisions of the Colorado River Compact, the apportionments made to and among them in the Colorado River Compact and the Upper Colorado River Basin Com-pact, respectively, providing for the reclamation of arid and semiarid land, for the control of floods and for the improvement of navigation, and the generation of hydro-electric power, as an incident of the foregoing purposes, hm'eby authorizes the Secreiaru of the Interior

to con-struct, operate, and maintain the following initial units of the Colorado River storage project, consisting of dams, res-ervoil's, powerplants, transmission facilities and app1£rtmwnt

16 works: Cross Mountain, Curecanti, Echo Park, Flaming

17 Gorge, Glen Canyon, and Navajo: Provided, That the

18

Curecanti Dam shall be constructed to a height which will

19 impound not less than nine hundred and forty thousand 20 acre-feet of water or will create a reservoir of such greater 21 capacity as can be obtained by a high waterline located 22 at seven thousand five hundred and twenty feet above mean

23 sea level and that construction thereof shall not be under-24 taken until the Secretary has, on the basis of further engi-25 neering and economic investigations, reexamined the economic

1 j~Lsti~cation of such unit and, accompanied by appropriate 2 documentation in the form of a supplemental report, has 3 certi~ed to the Congress and to the President that, in his 4 judgment, the bene~ts of such unit will exceed its costs;

and

(2)

to construct, operate, and maintain the following 6 additional reclamation projects (including power-generating 7 and transmission facilities related thereto), hereinafter re-8 [erred to as participating projects: Central Utah (initial 9 phase}; Emery County, Florida, Gooseberry, Hammond, La 10 Barge, Lyman, Paonia (including the Minnesota unit, a 11 dam and reserooir on Muddy Creek just above its

fluence with the North Fork of the Gunnison Rivel', and 13 other neceSSQ1'Yioorks] , Pine River Extension, Seedskadee,

and, accompanied by appropruue docu.mentation in the form

of a supplemental report, has certified to the Congress, thl'ough

the President, that, in his judgment, the benefits of such 20

project will exceed its costs, and that the financial

reim-21

bursability requirements set forth in section 4 of this Act

22

can be met. The Secretary's supplemental report for each 23

such project shall include, among other things, (i) a re-24

appraisal of the prospeciice direct agricultural benefits of

1 the project made by the Secreta1'y after consultation with 2 the Secretary of Agriculture;

(ii)

a reevaluation of the non-3 direct benefits of the project; and

(iii)

allocations of the 4 total cost of construction of each participating project 01'

5

separable [eaiures thereo], excluding any expenditures au-6 thorized by section

7

of this Act, to power, ir1'igation, mu-7 nicipal water supply, flood control 01' navigation, or any

8 other purpose authorized under reclamation law. Section

10 hereinafter provided for the San Juan-Chama and the 11 Navajo pa1,ticipating projects, not be applicable to such 12 supplemental reports; and, (b) that no app1'opriation for or construction of the San-Juan Chama project 01' the Navajo

participating project shall be made or begun until coordi-nated reports thereon shall have been submitted to the af-fected States, including (but without limiting the genemlity of the foregoing) the State of Texas, pursuant to the Act of December

22, 1944,

and said projects shall have been ap-p1'oved and auth07'ized by the Congress: Procuied. further, That with reference to the San Juan Chama project, it shall be limited to a single ott stream dam and reservoir on a tributary of the Chama River to be used solely for the control and regu-lation of

SEC.

2.

In order to achieve such comprehensive

develop-6 ment as will assure the consumptive use in the States of the 7 Upper Colorado River Basin of waters of the Colorado River 8 system the use of which

apportioned to the Upper C

olo-9 rado River Basin by the Colorado River Compact and to 10 each State thereof by the Upper Colorado River Basin

11 Compact, it

is

the intent of the Congress in the future to 12 authorize the construction, operation, and maintenance of 13 further units of the Colorado River storage project, of addi-14 tional phases of participating projects authorized in this Act, 15 and of new participating projects as additional information

16 becomes available and additional needs are indicated. It

is

17 hereby declared to be the purpose of the Congress to authorize 18 as participating projects only projects (including units or

19 phases

thereof)-20

(1)

for the use, in one or more of the States desig-21 nated in article III of the Upper Colorado River Basin 22 Compact, of waters of the Upper Colorado River system 23 the consumptive use of which

is

apportioned to those 24 States by that article; and

25

(2)

for which pertinent data sufficient to determine

their probable engineering and economic justification and

2

feasibility shall be available. It is likewise declared to be

3

the policy of the Congress that the costs of any

partici-4

pating project authorized in the future shall be amortized

5

from its own revenues to the fullest

extent

consistent with

6

the provisions of this Act and Federal reclamation law.

7

SEG.

3.

Except as othe1'wise p1'ovided in this Act, in

8

const1'ucting, operating, and maintaining the units of the

9

Colorado River storage p1'ojectand the participating projects

10

listed in section 1 of this Act, the Secretary shall be

erned by the Federal reclamation laws (Act of June

to any project contract unit over a period of not more than

fifty years exclusive of any development period authorized

19

by law; (b) prior to

All units and partici-9 pating projects shall be subject to the apportionments of the 10 use of water between the Upper and Lower Basins of the 11 Colorado River and among the States of the Upper Basin 12 (i:J;edin the Colorado River Compact and the Upper C olo-13 rado River Basin Oompact, respectively, and to the terms 14 of the treaty with the United Mexican States (Treaty Series 15

994).

16 SEC. 4. (a) There is hereby authorized a separate fund 17 tn the Treasury of the United States to be known as the 18 Upper Oolorado River Basin Fund (hereinafter referred to 19 as the Basin Fund), which shall remain available until ex-20 pended, as hereafter provided, for carrying out provisions of 21 this Act other than section 7.

(b) All appropriations made for the purpose of carrying

23 out the provisions of this Act, other than section 7, shall be 24 credited to the Basin Fund 'as advances from the general 25 fund of the Treasury. ,

c) All reoenues collected in connection with the

tion of the Colorado River storage project and pa1,ticipating

projects shall be credited to the Basin Fund, and shall be

available, without further appropriation, for

River storage project and participating projects, within such

8 separate limitations as may be included in annual

of the Paonia project which are beyond the ability of the

water users to repay within the period prescribed in the Act

any separable feature thereof which are allocated to power pursuant to section

5

of this Act, within a period not exceeding fifty years from the date of completion of such unit, participating project, or separable feature

thereof;

(2) the costs of each unit, participating project, or any separable feature thereof which are allocated to municipal water supply pursuant to section

5

of this Act, within a period not exceeding fifty years from the date of completion of such unit, participating project, or separable feature thereof;

(3) interest on the unamortized balance of the in-vestment (including inter-est during construction) in the

power and municipal water supply features of each unit, participating project, or any separable feature thereof, at a rate determined by the Secretary of the Treasury as provided in subsection (e), and interest due shall be a first charge; and

(4) the costs of each unit, participating project, or any separable feature thereof which are allocated to irrigation pursuant to section

of this Act within a period not exceeding fifty years, in addition to any de-velopment period authorized by law, from the date of completion of such unit, participating project, or sepa-rable feature thereof, or, in the cases of the Paonia

project and of Indian lands, within a period consistent

2

with other provisions of law applicable thereto.

The interest rate applicable to each unit of the

4

storage project and each participating project shall be

deter-5 mined

by

the Secretary of the Treasury as of the time the

6 first advance is made for initiating construction of said unit

7

or p1'oject. Such interest rate shall be determined by

cal-8 culating the average yield to maturity on the basis of daily

9

closing market bid quotations during the month of June

10

next preceding the fiscal year in which said advance is made,

11

on all interest-bem'ing mm'ketable public debt obligations of

12

the United States having a maturity date of fifteen or more

13

yem's from the first day of said month, and by adjusting such

14

average annual yield to the nearest one-eighth of

1

per

15

centum.

16

(f) Business-type budgets shall be submitted to the

Oon-17

gress annually f01' all operations financed by the Basin Fund.

18

SEC.

5.

Upon completion of each unit, participating

19

project or separable feature thereof the Secretary shall

allo-20

caie the total costs (excluding any expenditures authorized

21

by section 7 of this Act) of constructing said unit, project or

22

feature to power, irrigation, municipal water supply, flood

23

control, navigation, or any other purposes nuthorized. under

24

reclamation law.

Allocations of construction, operation and

1 shall be nonreturnable under the provisions of this Act. On

of each year the Secretary shall report to the 3 Congress for the previous fiscal year, beginning w,ith the fiscal

4

year

1955,

upon the status of the revenues from and the cost 5 of constructing, operating, and maintaining the Colorado

6 River storage project and the participating projects. The 7 Secretary's report shall be prepared to reflect accurately the 8 Federal investment allocated at that time to power, to irriga-9 tum, and to other purposes, the progress of return and

re-10 payment thereon, and the estimated rate of progress, year by 11 year, in accomplishing full repayment.

12 SEC.

6.

The hydroelectric powerplants authorized by this 13 Act to be constructed, operated, and maintained by the

Secre-14 tary shall be opemtedin conjunction with other Federal

15 powerplants, present and potential, so as to produce the

g1'eat-16 est practicable amount of power and energy that can be sold

17

at firm power and energy rates, but no exercise of the

18 authority hereby granted shall affect or interfere with the

19 operation of any provision of the Colorado River Compact, 20 the Upper Colorado River Basin Compact, or the Boulder

21 Canyon Project Act.

22 SEC. 7. In connection with the development of the Colo-23 rado River storaqe project and of the participating projects, 24 the Secretary is authorized and directed to investigate, plan, 25 construct, operate, and maintain (1) public recreational

ment of said project or of said pm'ticipating projects, to

3

conserve the scenery, the natural, historic, and archeoloqic

4

objects, and the wildlife on said lands, and to provide for

5

public use and enjoyment of the same and of the water areas

6 created by these p1'ojects by such means as are consistent

7

with the pTimary pUTposes of said projects; and

(2)

facili-8

ties to mitigate losses of and improve conditions for the

9

propagation of fish and wildlife.

ized to acquire lands and to withdraw public lands from

11

entTy or other disposition under the public land laws

neces-12

sary for the constTuction, operation, and maintenance of the

13

fdcilities herein 'provided, and to dispose of th~

SEG. 8. Nothing contained in this Act shall be construed

20

to alter, amend, repeal, construe, interpret, modify, or be in

21

conflict with any provision of the Boulder Oanyon Project

22 Act (45 Stat.

1057),

the Boulder Oanyon Project

Adju,st-23 ment Act (54 Stat. 774), the Colorado River Compact, the

or the Treaty with the United Mexican 2 States (Treaty Series

SEC.

9.

Expenditures for the Cross Mountain, Flaming' 4 Gorge, Glen Canyon, Navajo and Echo Park initial units 5 of the Colorado River storage project may be made without 6 regard to the soil survey and land classi~cation requirements 7 of the Interior Department Appropriation Act, 1954.

8 SEC. 10. There are hereby authorized to be appropriated 9 such sums as may be required to carry out the purposes of

10 this Act.

11 SEC.

11.

The appropriate agencies of the United States 12 are authorized to convey to the City and County of Denver, 13 Colorado, for use as a part of its municipally owned water

14 system, such interests in lands and water rights used or ac-15 quired by the United States solely for the generation of

16 power and other property of the United States as shall be 17 required in connection with the development or use of its 18 Blue River project, upon payment by Denver for any such 19 inte-rest of the value theree] at the time of its acquisition by

20 Denver, and provided that any such transfer shall be so 21 limited as not to preclude the use of the property other than 22 water rights for the necessary functions of the United States 23 Gove-rnment.

24 SEC.

12.

In the operation and maintenance of all facil-25 ities, authorized by Fede-ral law and under the jurisdiction

and supervision of the Secretary of the Interior, in the basin

2

of the Colorado River, the Secretary of the Interior is directed

3 . to comply with the applicable provisions of the Colorado

4

River Compact, the Boulder Canyon Project Act, the Boulder

5

Canyon Project Adjustment Act, and the Treaty with the

6

United Mexican States, in the storage and release of water

7

from reservoirs in the Colorado River Basin.

In the event

8

of the failure of the Secretary of the Interior to so comply,

9

any State of the Colorado River Basin may maintain an

10

action in the Supreme Court of the United States to enforce

11

the provisions of this section, and consent is given to the

12

joinder of the United States as a party in such suit

or

suits.

13

No right to impound
